Welcome to VIGAI. These Conditions of Use (“Terms”) govern your access to and use of the vigai.online website, the VIGAI Video Studio at editor.vigai.online, and all related services (together, the “Service”), operated by VIG AI Online (“VIGAI,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who May Use the Service
You must be at least 18 years old, or the age of majority where you live, to create an account. By using the Service you confirm that you meet this requirement and that any information you provide when registering is accurate and kept up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@vigai.online if you suspect unauthorized use of your account.
2. The Service
VIGAI is an AI-powered video creation platform. It lets you plan, generate, edit, and export video content using AI tools — including scene generation, voiceover, soundtrack, lip sync, captions, and a full timeline editor. AI-generated output depends on the prompts and materials you provide, and results can vary. We do not guarantee that any particular generation will meet your expectations, and generated content may occasionally contain errors, artifacts, or unexpected results.
3. Credits, Payments, and Refunds
Certain features of the Service — including AI generation and video rendering — consume credits. Before any credit-consuming job runs, the Service shows you the estimated cost and your current balance, and you must confirm before you are charged.
Credits are charged only when a job completes successfully. If a job fails or is cancelled, the credits held for it are automatically returned to your balance. Some AI providers support only fixed clip lengths; where your requested duration is adjusted to the nearest supported length, this will be reflected before you confirm.
Purchased credits are not legal tender, have no cash value, are non-transferable, and — except where required by law or expressly stated otherwise — are non-refundable once consumed by a successfully completed job. Prices for credit packs and subscriptions may change; changes apply only to future purchases.
4. Your Content
“Your Content” means the materials you upload to the Service (video, images, audio, text, prompts) and the outputs you generate with the Service using your account.
You retain ownership of the content you upload. By uploading it, you grant VIGAI a limited, worldwide, non-exclusive license to host, store, process, reproduce, and display Your Content solely as needed to operate and provide the Service (for example, to render your timeline into a video file).
As between you and VIGAI, and to the extent permitted by law, you own the video outputs you generate with the Service, and you may use them for personal or commercial purposes. You are responsible for ensuring your use of outputs complies with applicable law and does not infringe the rights of others. Note that the copyright status of AI-generated material varies by jurisdiction, and similar outputs may be generated for other users from similar prompts.
Your projects, media, and rendered videos are private to your account and are not shared with other users unless you choose to share them.
5. Content Rules and Acceptable Use
You agree not to upload, generate, or distribute through the Service any content that:
is illegal, or promotes illegal activity; infringes any copyright, trademark, right of publicity, privacy right, or other right of any person or entity; sexualizes or exploits minors in any form (we have zero tolerance for this and will report it to the relevant authorities); depicts real, identifiable people in a deceptive or harmful way, including non-consensual intimate imagery or deepfakes presented as genuine; constitutes fraud, phishing, or impersonation of any person or organization; is defamatory, harassing, or incites violence or hatred against any person or group; or contains malware or is designed to disrupt the Service.
You also agree not to: reverse engineer, scrape, or copy the Service; circumvent credit charges, rate limits, or security measures; resell or provide access to the Service to third parties without our written consent; or use the Service to build a competing dataset or train competing models.
We may remove content and suspend or terminate accounts that violate these rules.
6. Intellectual Property of the Service
The Service itself — including its software, design, interface, logos, and branding — is owned by VIGAI or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use the VIGAI name, logo, or branding without our prior written permission.
7. Third-Party Services
The Service uses third-party AI providers to power generation features. Your prompts and relevant materials may be processed by these providers as necessary to complete jobs you request. Third-party services are subject to their own terms, and we are not responsible for their availability or output.
8. Availability, Changes, and Data
We work to keep the Service available and your work safe (including cloud autosave), but the Service is provided on an “as is” and “as available” basis. We may modify, suspend, or discontinue features at any time. Rendered files remain available for download for a limited period and are also saved to your project assets; you are responsible for downloading and keeping copies of outputs you care about. We recommend exporting important work promptly.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, misuse the Service, or where required by law. Upon termination, your right to use the Service ends; sections of these Terms that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive.
10. Disclaimers
To the fullest extent permitted by law, VIGAI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated outputs will be accurate, high-quality, or fit for any particular use.
11. Limitation of Liability
To the fullest extent permitted by law, VIGAI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) fifty US dollars (USD $50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold VIGAI harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any third party’s rights.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Santa Cruz County, California, and you consent to their jurisdiction. You and VIGAI each waive any right to a jury trial and agree that claims may be brought only on an individual basis, not as a class action.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you — for example by email or an in-product notice — before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
